Bannon, 66, was arrested on a boat Thursday off the Eastern coast of Connecticut according to a law enforcement official. He will make his initial court appearance in New York later Thursday, according to the US attorney's office. Bill Burck, an attorney for Bannon, declined to comment. The four men are indicted for allegedly using hundreds of thousands of dollars donated to an online crowdfunding campaign called We Build the Wall for personal expenses, among other things. Bannon and another defendant, Brian Kolfage, promised donors that the campaign, which ultimately raised more than $25 million, was "a volunteer organization" and that "100% of the funds raised...will be used in the execution of our mission and purpose," according to the indictment unsealed Thursday." #TheDamageReport #JohnIadarola #TheYoungTurks

Roberts wrote in the decision that the government failed to give an adequate justification for ending the federal program. Black children, Native children, Latinx children, and the children of the poor have all been seized from their kin and caregivers. As Laura Briggs’s sweeping narrative shows, the practice played out on the auction block, in the boarding schools designed to pacify the Native American population, in the foster care system used to put down the Black freedom movement, in the US’s anti-Communist coups in Central America, and in the moral panic about “crack babies.” In chilling detail we see how Central Americans were made into a population that could be stripped of their children and how every US administration beginning with Reagan has put children of immigrants and refugees in detention camps. Yet these tactics of terror have encountered opposition from every generation, and Briggs challenges us to stand and resist in this powerful corrective to American history." #TheDamageReport #JohnIadarola #TheYoungTurks

These acts were later used by authorities to justify arresting women who agreed to them, seizing their assets, and telling the press it was these women who were the real predators. Federal agents had at least 17 sexual encounters with "Asian females" working in massage parlors around Mohave County, Arizona, over a five-month period in 2018, according to new research from the Howard Center for Investigative Journalism at Arizona State University (ASU). Internal ICE documents show these activities had the blessing of agents' supervisors. When it was all over, the years-long operation yielded three misdemeanor charges stemming from a single sexual encounter which authorities interrupted during a raid. Absurd and horrifying? Obviously. But also a scenario that is far from an isolated incident." #TheDamageReport #JohnIadarola #TheYoungTurks

More than 37,000 people are detained in facilities described by government inspectors, nongovernmental organizations, and the prisoners themselves as crowded and dirty. As two Department of Homeland Security doctors warned Congress, the facilities pose “an imminent risk to the health and safety of immigrant detainees” and to the public as well. On Friday, the Trump administration quietly designated the entire Customs and Border Protection (CBP) agency, which polices US borders, as a “Security Agency,” according to an internal memo obtained by The Nation. This follows repeated attempts by federal immigration authorities to dramatically expand their reach in recent years. The memo, which was signed by CBP’s Acting Commissioner Mark Morgan and dated January 31, places CBP under the same designation as highly secretive intelligence and law enforcement agencies like the FBI and Secret Service. This grants CBP greater secrecy by exempting certain records from disclosure to the public. The memo states: “I am pleased to announce CBP has been designated as a Security Agency under Office of Personnel Management’s (OPM) official Data Release Policy, effective immediately. Previously, only frontline law enforcement, investigative, or intelligence positions held this designation. This policy change now protects all CBP employee names from subsequent responses to Freedom of Information Act requests or other public disclosures for CGP employee data.”" #TheDamageReport #JohnIadarola #TheYoungTurks

The court voted 5-4. Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan said they would have left a lower court ruling in place that blocked enforcement while a legal challenge works its way through the courts. The Department of Homeland Security announced in August that it would expand the definition of "public charge," to be applied to people whose immigration to the United States could be denied because of a concern that they would primarily depend on the government for their income. In the past, that was largely based on an assessment that an immigrant would be dependent upon cash benefits. But the Trump administration proposed to broaden the definition to include noncash benefits, such as Medicaid, supplemental nutrition and federal housing assistance. Anyone who would be likely to require that broader range of help for more than 12 months in any three-year period would be swept into the expanded definition." #TheDamageReport #JohnIadarola #TheYoungTurks

Trump administration brutally targets pregnant women. John Iadarola breaks it down on The Damage Report. The cable, sent Wednesday afternoon and marked “sensitive but unclassified,” turns a suspicion among immigration restrictionists that people are trying to game America’s visa system into official US policy, starting on Friday, January 24. The apparent goal is to clamp down on foreigners giving birth to children in the US who become, by birth, American citizens. A draft of the State Department guidance was first reported on by BuzzFeed on Tuesday. The guidance would create new barriers for pregnant people at consulates abroad applying for B visas, which are offered to short-term visitors, including tourists, business travelers, and people seeking urgent medical care. The government does not track how many pregnant travelers come to the US on B visas, but 2017 data from the Centers for Disease Control and Prevention suggests that the new guidance would likely affect roughly 10,000 people annually. According to one State Department official, pregnant people applying for these kinds of visas may not receive the kind of care they need in their home country or have the money to get better care in the US." #TheDamageReport #JohnIadarola #TheYoungTurks

Migrant kids were tortured by detention staffers at a juvenile hall in Virginia. John Iadarola breaks it down on The Damage Report. Staff members at the Virginia juvenile hall where he was held would call him pendejo and “onion head,” he said. After fleeing violence in Mexico at age 15 and arriving alone at the US border, he’d been sent to Shenandoah Valley Juvenile Center in 2016 and held alongside American teens while he awaited immigration proceedings. Shenandoah is one of two juvenile halls nationally that the Office of Refugee Resettlement uses to hold unaccompanied minors who are deemed threatening. Now a group of district attorneys from around the country—including reformers Larry Krasner, Chesa Boudin, and Kim Foxx—have filed a brief citing concerns about the immigrant teens’ treatment there. Antonio hadn’t broken the law, but his detention in Virginia felt like a punishment: Once, when he got in a fight with an American kid who taunted him, he says staffers restrained him by tying him to a chair for four hours, allegedly hitting him while he sat there. Over a year and a half at Shenandoah, Antonio (not his real name) says he was tied to the chair about five times. In court documents, he recounted that staffers who restrained him would sometimes put a bag over his head, meant to deter biting or spitting. “It had small holes that I could see out of, but only a little,” he said." #TheDamageReport #JohnIadarola #TheYoungTurks
